1. Overview

These Terms of Service (“Terms”) govern your use of thebrick.ai and any related services operated by The Tokenry, Inc. (“The Tokenry,” “we,” “us”). The Brick is currently available for preorder only and has not yet shipped. By placing a preorder or using our website you agree to be bound by these Terms. If you do not agree, do not use our services.

2. Preorder & Payment

When you reserve a Brick, a $20 USD refundable deposit is charged immediately through Stripe, our third-party payment processor. This deposit reserves your unit at the $299 USD first-run price. We currently estimate shipping to begin in Summer 2026, but this date is not guaranteed and may change.

Before your Brick ships, we will charge the remaining balance ($299 minus your deposit) plus applicable shipping costs through Stripe. You will be notified and have the opportunity to review the total amount before it is charged. Shipping is not included in the $299 device price. If you do not wish to proceed, you may cancel your reservation for a full refund of your deposit.

A reservation secures your place in our production queue and locks in the first-run price. During checkout, we also collect your shipping address so we can calculate and communicate your shipping cost when production is complete.

3. Cancellation & Refunds

Before your Brick ships

Your deposit is fully refundable, no questions asked. You may cancel your reservation and receive a full refund of your deposit at any time before your Brick ships by emailing us at the address listed below. If the estimated ship date changes by more than 6 months from the date shown at the time of your order, we will notify you and you may cancel for a full refund.

After delivery

You may return your Brick within 14 days of delivery. The device must be in its original condition and packaging. Shipping costs for returns are the responsibility of the buyer, and a 15% restocking fee will be deducted from your refund. After 14 days, all sales are final.

4. Product Description

The Brick is a dedicated hardware device designed to run always-on AI agents. The planned configuration includes OpenClaw pre-installed, a hardened Linux build, 8 GB RAM, 128 GB SSD, and an NFC chip for phone pairing. Because the Brick is in preorder and not yet in production, hardware specifications, included software, and features may change before the final unit ships. We will notify preorder customers of any material changes.

The Brick is a general-purpose Linux computer. While it is optimized for running AI agents, you are free to use it for any lawful purpose. Nothing is locked down.

5. brickOS App & Services

brickOS is a planned companion app that will provide messaging, integrations, and observability for agents running on your Brick. brickOS is currently in development and is not yet available. Use of the app will not be required to operate the hardware.

6. Acceptable Use

You agree not to use The Brick or brickOS to:

We reserve the right to suspend or terminate access to brickOS services for violations of this policy. The hardware itself remains yours regardless.

7. Limitation of Liability

To the maximum extent permitted by law, The Tokenry shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Brick or brickOS.

Our total liability for any claim arising from these Terms or your use of our products shall not exceed the amount you paid to us in the twelve months preceding the claim.

The Brick runs third-party software including OpenClaw and cloud-based LLM services. We are not responsible for the actions, outputs, or failures of AI agents you deploy, nor for the availability or performance of third-party APIs and services.

The Brick is offered as a preorder product. We make no warranty, express or implied, regarding the final production timeline, specifications, or fitness for a particular purpose until the product has shipped. Preorder customers assume the risk that the final product may differ from current descriptions.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Thurston County, Washington.

9. Modifications

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on our website at least 30 days before the changes take effect. Your continued use of our services after the effective date constitutes acceptance of the revised Terms.
